Patent Eligibility
Before executing a patentability search, you need to do a preliminary evaluation that determines if your invention qualifies as patentable subject matter. This evaluation assesses the invention’s potential to meet the legal requirements and identifies any potential exclusions or limitations.

Patentability Search
If your patent already exists, or is an obvious variant of something that already exists, then your patent will be rejected. A patent search can give you an idea if it is even worth applying for a patent for your invention.

Provisional Patent Application
If the patent search comes back clear, you can file a patent application. A provisional patent application will get you patent pending or “Pat. Pend.” status for one (1) year and can provide a basis for foreign patent filings.

Design Patent Application
A design patent prevents others from making, using, or selling a product that resembles your patented design. It provides the inventor with exclusive rights to the design, protecting its unique visual appearance including shape, configuration, or surface ornamentation.

Utility Patent Application
A utility patent protects your invention’s functional aspects and grants exclusive rights for up to 20 years, preventing others from making, using, or selling the invention. The application includes a detailed specification, claims, and drawings.

International Filing
A US Patent only protects your invention in the United States. To protect your invention outside of the United States, you will need to file for international protection. We can file an international patent application that covers most foreign countries. We also work with leading law firms in other countries to help you file directly in the countries you need protection in.

Mark Trenner is a patent attorney registered to practice before the United States Patent Office. He has over 20 years of experience in intellectual property law.
Mark started Trenner Law Firm, LLC in 2004 to serve the small business and start-up community. He has worked since then to help entrepreneurs, small business owners, and individual inventors build strong patent portfolios that can add significant value to a product or business.

Mark received his law degree from the University of Denver College of Law, and worked for several Intellectual Property Law Firms representing major software, electronics, and medical device companies. He also served in-house as Senior Patent Counsel for 4 years to the U.S. Department of Energy National Renewable Energy Laboratory before starting his own law firm.
